1. Acceptance of Terms By accessing or using the Brandifi mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). These Terms govern your access to and use of Brandifi and its related services (collectively, the “Service”). If you do not agree to these Terms, you must not use the Service.
2. Description of Service Brandifi provides a digital platform for users (“Users”) to connect with creatives in various fields, including graphic design, photography, videography, and more. The Service allows Users to browse, communicate, and engage with creatives for the purpose of obtaining their services.
3. User Accounts To use certain features of the Service, you must register for an account. You are responsible for maintaining the confidentiality of your account information and for all activities conducted through your account. You agree to notify Brandifi immediately of any unauthorized use of your account.
4. Content a. User-Generated Content: Users may post content, including text, photos, and other media. You retain all rights in, and are solely responsible for, the User-Generated Content you post to Brandifi. b. Brandifi’s Rights: Brandifi reserves the right to remove any content that violates these Terms or that is deemed offensive, illegal, or detrimental to the Service.
5. Intellectual Property All intellectual property rights in the App and Service are owned by or licensed to Brandifi. No transfer of intellectual property rights is made by these Terms. You are granted a limited, non-exclusive, revocable license to make personal, non-commercial use of the App and Service.
6. Prohibited Activities You may not access or use the Service for any purpose other than that for which Brandifi makes it available. Prohibited activities include, but are not limited to, engaging in illegal activities, infringing upon the intellectual property rights of others, and disrupting the App or Service in any manner.
7. Termination Brandifi may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately.
8. Disclaimer of Warranties The Service is provided “as is”. Brandifi and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement.
9. Limitation of Liability In no event will Brandifi, or its suppliers or licensors, be liable with respect to any subject matter of these Terms under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data.
10. General Terms These Terms constitute the entire agreement between you and Brandifi regarding the use of the Service. The failure of Brandifi to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
